Recreational use of cannabis remains illegal.<\/li><li><a href=\"#CBPM-Growth-2024\">Unlicensed CBPM prescriptions in the private sector are<\/a> <a href=\"#CBPM-Growth-2024\">quickly rising<\/a> &#8211; especially in the past 3 years. However, CBPM prescriptions by the NHS are negligible &#8211; only under 5 a month.\u00a0<\/li><li>CBPM prescriptions in the private sector have risen 130% in 2024 compared to 2023, according to a <a href=\"https:\/\/www.cqc.org.uk\/publications\/controlled-drugs\/2024\/issues\" target=\"_blank\" rel=\"noopener\" data-wplink-edit=\"true\">report by the Care Quality Commission (CQC)<\/a><\/li><li>The <a href=\"#CBPM-prescriptions-dwarf-mainstream-drugs\">percentage growth of prescriptions for CBPMs exceed those of mainstream drugs<\/a> such as Atorvastatin, Amlodipine, Omeprazole and Ramipril.<\/li><li>However, the CQC expresses its concerns around <a href=\"#CBPM-coordination-communication\">poor communication &amp; coordination<\/a> between providers, GPs and the patients themselves, the <a href=\"#CBPM-safety-and-legality\">questionable safety &amp; legality<\/a> of current prescriptions, the lack of documented evidence justifying a CBPM will fulfill an <a href=\"#CBPM-unmet-clinical-need\">unmet clinical need<\/a>, and the adherence to <a href=\"#CBPM-advertising\">ethical advertising<\/a> practices.<\/li><li>Growth for UK&#8217;s medical cannabis industry is promising &#8211; while still remaining illegal for recreational use.<\/p><p>In 2018, several reviews were conducted by the British government into cannabis and cannabis-related products resulting in evidence that supported its medicinal benefit for certain conditions.<\/p><p>As a result, the government announced its intentions to allow providers to prescribe <a href=\"https:\/\/www.england.nhs.uk\/long-read\/cannabis-based-products-for-medicinal-use-cbpms\/\" target=\"_blank\" rel=\"noopener\">cannabis-based products for medicinal use (CBPMs)<\/a> with the first move being to<strong>\u00a0reclassify it from Schedule 1 to Schedule 2<\/strong> of the Misuse of Drugs Regulations 2001.<\/p><p>It is also important to note &#8211; however, the lack of NHS authorisations and education hinders any growth in CBM prescriptions.<\/li><\/ul><p>Currently, there exists only 3 CBMs in the UK, namely: <a href=\"https:\/\/www.hweclinicalguidance.nhs.uk\/all-clinical-areas-documents\/download?cid=3889&amp;checksum=86098ef82c97fa789a47a8d2e8800794\" target=\"_blank\" rel=\"noopener\"><strong>Epidyolex, Nabilone, and Sativex<\/strong><\/a>. However, despite their legality &amp; availability, the <a href=\"https:\/\/cannabishealthnews.co.uk\/2024\/11\/06\/nhs-accused-of-failing-patients-as-families-make-fresh-plea-for-access\/\" target=\"_blank\" rel=\"noopener\">NHS strongly advises doctors not to freely prescribe them.<\/a><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-155bf82 elementor-widget elementor-widget-spacer\" data-id=\"155bf82\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div have <strong>received marketing authorisation<\/strong> from the medicines regulator (either the MHRA or the EMA), yet still meet the criteria of a CBPM under Regulation 2(1) of the MDR. <strong>As of 2025, the UK has no registered licensed CBPM.\u00a0<\/strong>It is generally understood that a licensed CBPM &#8211; passing rigorous clinical trial and receiving marketing authorisation &#8211; will <strong>most likely be classified as a CBM.<\/strong><\/p><p><em><strong>&#8216;Unlicensed CBPMs&#8217;<\/strong>, <\/em>on the other hand,\u00a0refers to products that meet the definition of a CBPM, but <strong>have not been evaluated for safety, quality or efficacy<\/strong> by regulatory bodies, such as the Medicines and Healthcare products Regulatory Agency (MHRA) or the European Medicines Agency (EMA).<\/p><p>The <a href=\"https:\/\/www.gov.uk\/government\/publications\/supply-unlicensed-medicinal-products-specials\/supply-unlicensed-medicinal-products-specials\" target=\"_blank\" rel=\"noopener\">MHA offers guidance<\/a> on manufacturing, importing, distributing or supplying unlicensed CBPMs.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element href=\"https:\/\/www.gmc-uk.org\/professional-standards\/learning-materials\/information-for-doctors-on-cannabis-based-products-for-medicinal-use\" target=\"_blank\" rel=\"noopener\">General Medical Council<\/a>, CBPM prescriptions can only be made:<\/p><ul><li>By <strong>doctors on the specialist register of the General Medical Council<\/strong><\/li><li>If it lies within the <strong>specialist doctor&#8217;s own area of practice and training\/limits of competence<\/strong><\/li><li>If the decision has been <strong>agreed upon by a multidisciplinary team<\/strong><\/li><li>When there is<strong> no other suitably licensed medicine available<\/strong> that will meet the patient\u2019s need.<\/li><\/ul><p>If you are a healthcare professional wanting to learn more, the National Health Service (NHS) England have developed an <a href=\"#CBPM-E-Learning-Package-NHS\">e-learning package<\/a> in 2018 in collaboration with the Health Education England and the University of acquire medical cannabis from the NHS &#8211; especially for CBPMs.<\/p><p>When looking at CBMs (i.e., Epidyolex, Nabilone &amp; Sativex), a <a href=\"https:\/\/questions-statements.parliament.uk\/written-questions\/detail\/2024-12-04\/17970\" target=\"_blank\" rel=\"noopener\">statement by the UK&#8217;s Department of Health &amp; Social Care<\/a> reveals a steady increase in the number of NHS prescriptions for licensed cannabis-based medicines since 2018, with a 16% dip in 2024 (as seen in the diagram below).<\/p><p>However, these numbers are relatively low considering how in 2023 &#8211; the year with a noticeable spike &#8211; there were only 1,104 patients prescribed CBMs, an increase of merely 127 patients compared to 2021.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0449685 elementor-widget elementor-widget-image\" data-id=\"0449685\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<img decoding=\"async\" CBPMs, on the other hand, the number of NHS prescriptions for cannabis-based products for medicinal use were virtually negligible &#8211; <a href=\"https:\/\/www.bbc.com\/news\/health-66784170\" target=\"_blank\" rel=\"noopener\">often fewer than 5 per month<\/a> &#8211; as <a href=\"https:\/\/questions-statements.parliament.uk\/written-questions\/detail\/2023-01-06\/117459\" target=\"_blank\" rel=\"noopener\">revealed by former Health Minister, Will Quince in 2023.<\/a><\/p><p>These prescriptions went out to just a handful of <strong>children with<\/strong> <strong data-start=\"35\" data-end=\"99\">extremely rare, treatment-resistant epilepsies<\/strong> not controllable by standard therapies, such as a <a href=\"https:\/\/www.bbc.com\/news\/uk-england-somerset-67171305\" target=\"_blank\" rel=\"noopener\">four-year old girl with Aicardi syndrome<\/a>, a rare genetic neurological disorder.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-18dc703 elementor-widget elementor-widget-spacer\" data-id=\"18dc703\" associated with it.<\/li><li>Some specialists who are aware of it argue that there is <strong>not enough evidence regarding the drug&#8217;s safety and effectiveness<\/strong>\u00a0<b>(i.e., lack of randomized controlled trial (RCT) data) <\/b>to justify its prescription.<\/li><li>The specialists who do want to prescribe unlicensed cannabis-based products <strong>almost always get turned down for funding<\/strong> by the NHS.<\/li><li>NHS trusts <strong>often refer patients to private clinics.<\/strong><\/li><\/ul><p>Naturally, many patients, believing CBPMs could be freely prescribed by specialist doctors, felt misled. And as a result, they had to either forego, or pay privately.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bf31666 elementor-widget elementor-widget-spacer\" data-id=\"bf31666\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d01d102 elementor-widget elementor-widget-heading\" data-id=\"d01d102\" data-element_type=\"widget\" data-e-type=\"widget\" id=\"CBPM-Private-Sector-Boom\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">The Resulting Boom in Private Sector CBPM prescriptions<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b199e55 elementor-widget elementor-widget-text-editor\" data-id=\"b199e55\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Due to the difficulty in obtaining CBPMs from the NHS, many patients have instead opted for sourcing via the private sector. According to a recently released <a href=\"https:\/\/www.cqc.org.uk\/publications\/controlled-drugs\/2024\/issues\" target=\"_blank\" rel=\"noopener\">report of 2024 by the Care Quality Commission (CQC)<\/a>:<\/p><ul><li><strong>35 independent clinics<\/strong> were prescribing unlicensed CBPMs.<\/li><li>Almost all prescriptions for CBPMs remain <strong>within the private sector<\/strong>.<\/li><li>Comparing 2023 to 2024, the number of <strong>prescribed items jumped by<\/strong> <strong data-start=\"770\" data-end=\"778\">130%<\/strong> &#8211; from 150,527 (April &#8217;22 to March &#8217;23) to 346,600 (April &#8217;23 to March &#8217;24)<\/li><li>A <strong>clear upward trend<\/strong> in number of prescriptions, especially in the last 3 years.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7edfc30 elementor-widget elementor-widget-image\" data-id=\"7edfc30\" comparing the annual number of prescription of CBPMs against the most prescribed drugs in the UK, from 2020 to 2024:<\/p><ul><li data-start=\"1863\" data-end=\"1904\"><p data-start=\"1865\" data-end=\"1904\"><span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\"><strong>CBPM prescriptions, driven by the private sector, are indeed growing at a faster percentage rate<\/strong> (doubling annually or around 80\u202f% CAGR across 2021\u20132023), dwarfing percentage growth of mainstream drugs such as Atorvastatin, Amlodipine, Omeprazole, and Ramipril.<\/span><\/p><\/li><li data-start=\"1905\" data-end=\"1946\"><p data-start=\"1907\" data-end=\"1946\"><span class=\"relative -mx-px my-[-0.2rem] rounded px-px py-[0.2rem] transition-colors duration-100 ease-in-out\"><strong>But in absolute volume, CBPM prescriptions remain minuscule <\/strong>compared to the millions of prescriptions for statins, PPIs, and antihypertensives.<\/span><\/p><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-47fa635 elementor-widget elementor-widget-image\" psychiatric conditions (e.g., PTSD, ADHD)<\/p><p>These findings align with Lumino&#8217;s data based on the number of placements we&#8217;ve made for psychologists and neurologists in the UK over the CBPM prescriptions, there remain several persistent issues that can lead to the potential harm of patients, <a href=\"https:\/\/www.cqc.org.uk\/publications\/controlled-drugs\/2024\/issues\" target=\"_blank\" rel=\"noopener\">according to a CQC report<\/a>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f31246f elementor-widget elementor-widget-spacer\" data-id=\"f31246f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9bc983f elementor-widget This lack of coordination can put patients at risk, especially when CBPMs are involved in complex care plans that require input from multiple specialists.<\/p><p>Secondly, clinics often fail to <strong>inform patients on how to prove they are in legal possession of a CBPM<\/strong>. As such, clinics should offer patients clear guidance during the CBPM prescription process. The NHS has published information on this &#8211; available in the <a href=\"#CBPM-prescription-proof\">footnotes of this blog article<\/a>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a00aa67 elementor-widget elementor-widget-spacer\" data-id=\"a00aa67\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-37a17c2 elementor-widget elementor-widget-heading\" data-id=\"37a17c2\" data-element_type=\"widget\" data-e-type=\"widget\" id=\"CBPM-safety-and-legality\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">2. Questionable Safety and Legality of Current Prescriptions<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-373cd1a elementor-widget elementor-widget-text-editor\" data-id=\"373cd1a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Most non-medical prescribing is done by pharmacists, so the first concern here is if all pharmacy prescribers do indeed <strong>work within their scope of practice<\/strong> (as highlighted in <a href=\"https:\/\/assets.pharmacyregulation.org\/files\/2024-01\/in-practice-guidance-for-pharmacist-prescribers-february-2020.pdf\" target=\"_blank\" rel=\"noopener\">this guide by the General Pharmaceutical Council<\/a>).<\/p><p>Secondly, by law, <strong>medical specialists should have oversight on patients&#8217; care &#8211; including prescriptions<\/strong>, so any services that prescribe CBPMs must certify for themselves that these medical specialists are exercising due diligence in the practice of this oversight.<\/p><p>Thirdly, it is essential that a <strong>peer review be conducted before prescriptions are made<\/strong>. This requires <strong>having a multi-disciplinary team comprising the relevant specialists to approve prescriptions<\/strong> &#8211; particularly for complex cases. Unfortunately, some clinics and small providers still fall short in these areas, and lack the appropriate specialisms in their team to make well-rounded decisions. Furthermore, such incidents are not always being reported as required.<\/p><p>As such, the CQC urges all providers to <strong>advise the relevant NHS England CDAO of any incident or concern that occurs<\/strong>, through the\u00a0<a href=\"http:\/\/www.cdreporting.co.uk\/\">Controlled drug reporting tool<\/a>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-650419f elementor-widget elementor-widget-spacer\" data-id=\"650419f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ab5719c elementor-widget elementor-widget-heading\" data-id=\"ab5719c\" data-element_type=\"widget\" data-e-type=\"widget\" id=\"CBPM-unmet-clinical-need\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">3. Must be an \"Unmet Clinical Need\"<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-803b52f elementor-widget elementor-widget-text-editor\" data-id=\"803b52f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>CBPMs should strictly be prescribed when there\u2019s a <strong>verifiable unmet clinical need<\/strong>.<\/p><p>According to the <a href=\"https:\/\/www.cqc.org.uk\/publications\/controlled-drugs\/2024\/issues\" target=\"_blank\" rel=\"noopener\">CQC<\/a>, CBPM prescriptions are made for a wide variety of medical conditions &#8211; some of these having arguably little evidence to justify CBPM use.<\/p><p>Some clinics suggest patients need to have tried two prior treatments, but this threshold isn&#8217;t always enough. advice on CBPMs.<\/a><\/em><br \/><br \/>A cannabis-based product for medicinal use in humans (CBPM) is defined in Regulation 2(1) of the Misuse of Drugs Regulations 2001 (the 2001 Regulations). In summary, a CBPM must meet the following criteria:<\/p><ul><li><p>It must <strong>contain cannabis, cannabis resin, cannabinol, or a cannabinol derivative<\/strong>;<\/p><\/li><li><p>It must be <strong>produced for medicinal use in humans<\/strong>; and<\/p><\/li><li><p>It must either <strong>be a medicinal product (in regulatory terms) or a component of a medicinal product.<\/strong><\/p><\/li><\/ul><p>From 1 November 2018, the introduction of Regulation 16A into the 2001 Regulations provided that CBPMs are exempt from certain restrictions that would otherwise apply to controlled drugs under the Misuse of Drugs Act.<\/p><p>Regulation 16A does not represent a general relaxation of controls on CBPMs in England. Rather, it permits specific exemptions to the prohibitions in the Act, allowing the ordering or supply of a CBPM for administration in the following three situations:<\/p><ol><li><p>The CBPM <strong>holds a marketing authorisation<\/strong> (i.e. it is a licensed medicine). For example, NHS England identifies cannabidiol oral solution (Epidyolex\u00ae) as a licensed CBPM, having undergone randomised controlled trials for epilepsy syndromes such as Dravet syndrome, Lennox-Gastaut syndrome, and tuberous sclerosis complex;<\/p><\/li><li><p>The CBPM is <strong>used for the purposes of a clinical trial<\/strong> (i.e. as an \u2018investigational\u2019 medicinal product).
